Terms of Service
DEFINITIONSARTIST: The individual producing the Commission ("Fork")CLIENT: The individual purchasing the Commission.COMMISSION: The form of service provided by the Artist to the Client per the Commission Agreement. “Commission,” “Art[work],” “Image[ry]” and “Projects[s]” are used interchangeably herein and in Commission correspondence.COMMISSION AGREEMENT: The discussion, documented via email or direct message service (Twitter/X/Discord/Tumblr etc), in which the Artist and Client agree to the subject matter and type of Commission to be produced, the Commission price, the point in time in which the Artist is expected to commence in Start of Work, and - if applicable - the Commission deadlines, early termination circumstances, rush fees, Transfer of Copyright, and/or whether or not the Commission can be immediately displayed in the Artist’s portfolio or social media accounts owned by the Artist. This Commission Agreement shall remain on record with the Artist, along with any other documents related to the Commission.START OF WORK: The point in time by which the Client has approved the Artist to start work on the Commission (e.g., Artist begins to create the Commission).PROFILES: Online locations where the Commission may be displayed (e.g., “galleries,” such as Twitter.com, Tumblr.com, Instagram.com etc.). “Profile(s)” do not include any sites that display hateful or racist imagery, illegal activities, or sites known to display, reproduce, and/or sell works without crediting the Artist. Additionally, no Commission may be displayed without notifying the Artist first, or as agreed upon in the Commission Agreement.PERSONAL SPACE: Non-public, offline locations (e.g., home or office); i.e., no business involving the Commission is being conducted.PUBLIC SPACE: Offline locations that do not fall under “Personal Space” above.TRANSFER OF COPYRIGHT AGREEMENT: The discussion, documented via email or direct messaging service (Twitter, Tumblr, Discord etc.), in which the Artist and Client agree to transfer Copyright of the Commission from the Artist to the Client. This does not include Trademark.
TERMS
1. SALE:
The Artist hereby sells or transfers the Commission to the Client at the agreed value written in the Commission Agreement prior to the Start of Work.2. PAYMENT:
Full payments/half payment must be made in the signing/confirmation of the Commission Agreement prior to the Start of Work, or alternatively, a 50% up-front fee can be paid after the approval of the Commission Draft/Thumbnail Sketch[es] if arranged during the Commission Agreement. In the event that payment is made in instalments (i.e. 50% up-front), ownership of the Commission will only pass from the Artist to the Client on receipt of payment in full. The Commission will not be sent to the Purchaser until the agreed payment amount has been received. Payment method is determined as written in the Commission Agreement prior to the Start of Work (i.e. Paypal, Venmo etc.). The Artist will confirm payment once the illustration specifications have been agreed upon by the Client; any further work on the Commission will be with-held until mutual agreement is made and payment received.
NOTE: All prices are specified as Great British Pound (£GBP). It is the Client’s responsibility to ensure that they have converted currencies based on current exchange rates at the time of purchase. Any NSFW commissions will not be paid through PayPal and will be through Arty.ooo instead.3. DECLINE OF OFFERS:
The Artist has the right to refuse any Commission request, without needing to explain the reason (however, the Artist may explain reasoning for decline out of courtesy).4. PRIORITY OF OFFERS:
Due to the Artist’s full-time work, and the nature of said work hours, the Artist will prioritise each Commission request accordingly. Commission offers that satisfy the following components are placed as higher priority than other offers. These components include: The Artist’s skill level, availability, flexibility of deadlines, subject matter, pricing and payment. For example, commission offers based on particular subject matters that pertains the Artist’s interest will be placed at higher priority than subject matters that are not in the Artist’s relevant interests.
NOTE: The Artist will not create any form of hateful, homophobic or racist imagery.5. ARTIST CANCELLATION OF COMMISSION:
The Artist reserves the right to stop work on a Commission, or cancel a Commission request due to poor communication, rude/inappropriate behaviour, and inability to effectively communicate in the English language, or a breach of these Terms of Service.6. ARTIST COPYRIGHT AND REPRODUCTION:
By commissioning the Artist, the Client is purchasing the Artist’s labour only. The Artist retains all rights to the Commission, which includes but is not limited to: Distribution, reproduction, use of the Commission for Artist promotion (e.g. Profiles, Personal Space, Public Space, as defined in the Definitions section herein, etc.); or as it applies to new Terms of Service agreed upon in a “Transfer of Copyright Agreement” as defined in the Client Documents. The Client may not distribute, reproduce, or otherwise profit from the Commission. The Client may not edit, alter, or trace the Commission without the Artist’s expressed written permission, or as agreed upon in the Commission Agreement prior to Start of Work. Artist also retains full copyright for any preliminary designs and incidental works made in the creation of the Commission, unless otherwise agreed upon.
NOTE: For any Commissions which are Lineart only, the Client may commission another artist or colour the Lineart themselves without need for the Artist’s permission. However, the above other conditions still apply for the finished artwork unless otherwise agreed within the Commission Agreement.7. COMMISSION DESCRIPTION:
The Client must specify the content of their Commission to the best of their ability prior to a Commission Agreement. A complex Commission will incur additional illustration fees, to be defined and agreed upon in the Commission Agreement prior to Start of Work. The Client must specify the desired display size of the Commission, regardless of whether the Commission is completed digitally or traditionally. A large display size will incur additional illustration fees, to be defined and agreed upon in the Commission Agreement prior to Start of Work. Commission pricing details can be viewed on the Artist’s Profiles; all prices are as a guide only and may not represent the final price of a particular Commission.8. DEADLINES AND FLEXIBILITY:
The Artist will NOT take on Commissions that have a) strict or short deadlines; and b) if the Client is not flexible on deadlines. This is due to the nature of the Artist’s full-time work and is non-negotiable. If the Commission is time-sensitive, a rush fee may be applied, to be defined and agreed upon in the Commission Agreement prior to Start of Work. The Artist, to the best of their ability, can give a general indication of how long the Commission will take to complete, and when the Client can expect to receive the finished product prior to the Start of Work. The Artist will inform the Client regularly of progress (including photos/screenshots) or if changes to completion times have occurred. The Artist is not obliged to explain reasoning behind extensions or delays for the completion of a Commission, but may do so out of courtesy.9. CONFIDENTIALITY:
If the Commission is defined as confidential in the Commission Agreement, the Artist will temporarily delay public display of the image at the request of the Client and defined in the Commission Agreement until such time the Commission Agreement specified public display is permitted. A Client may not request the Artist to complete a Commission without defining the time-span in the Commission Agreement to eventually allow the Artist to publicly display the image. Additional fees may be charged for Non-Disclosure Agreements.10. PUBLIC DISPLAY AND USE:
The Client may display the Commission in Profiles as long as the Artist’s name (“its_a_fork” or "Fork") is prominently displayed along with a link to https://itsafork.carrd.co/ or “@its_a_fork” for Twitter or “@its-a-fork” for Tumblr. The corresponding usernames for each social media platform will be stated on the Commission Agreement and on the Commission Terms and Conditions. Additionally, any Profile display of the Artist’s Commission must notify the Artist, unless already defined in the Commission Agreement prior to Start of Work. The Client cannot display a Commission outside of Personal Space or in a Public Space unless the Commission is executed under new Terms of Service agreed upon in the Commission Agreement prior to Start of Work. The Client must obtain written permission from the Artist prior to displaying the Commission in a Public Space if not already defined in the Commission Agreement; additional fees may apply.11. COMPETITIONS:
Under no circumstances may the Client submit a Commission to any kind of online or offline contest.12. DIGITAL COMMISSIONS:
Digital art Commissions will be provided to the Client via email on an online download location in .jpeg or .png format (PDF possible); this does not include the Commission native files (e.g., .psd, .tif, etc.), unless agreed upon in the Commission Agreement, or thereafter, the Client obtains written permission from the Artist (additional fees may apply). Files will be of the highest resolution and include both sign/watermarked and un-watermarked copies of the finished product. The Artist will not be providing any physical/tangible versions of the artwork or pay for the cost of shipping a Commission (traditional art Commissions or any digital media device [e.g. CD, DVD, flash drive, etc.] or print of a digital art Commission.)13. PRINTS AND PRODUCTS:
The Artist is not responsible for printing [creating a hard copy of] a digital art Commission, or reproducing prints of a traditional art Commission for the Client unless agreed upon in the Commission Agreement. The Client may use the digital (.jpeg, .png or .PDF) file for local printing, so long as it does not breach Term 6 (ARTIST COPYRIGHT AND REPRODUCTION), Term 10 (PUBLIC DISPLAY AND USE) and Term 11 (COMPETITIONS), and the Client obtains expressed written permission from the Artist prior to printing.14. PROMOTION:
The Artist may use any images of the Commission for promotional purposes, unless otherwise agreed upon in the Commission Agreement (see Term 9 - CONFIDENTIALITY). The Artist may also sell Limited Edition Prints or merchandise of the Commission (i.e. art books) only with written agreement from the Client.15. ADDRESS NOTICE:
The Client is responsible for ensuring that contact details are true and correct. Either party shall notify the other party in case of change of email address or contact details prior to such change.16. EXPIRATION:
This contract binds the parties, their heirs, all the successors in interest, and all Client’s obligations are attached to the Commission and go with ownership of the Commission, all for the life of the Artist and Artist’s surviving spouse plus twenty-one (21) years, unless otherwise stated.17. MORAL RIGHT:
The Client will not permit any use of the Artist’s name or misuse of the Commission which would reflect discredit on his/her reputation as an artist, or which would violate the spirit of the Commission.18. REFUND POLICY:
If the Client is unsatisfied with the final Commission for an appropriate reason, they must contact the Artist within fourteen (14) days of receiving the final Commission, and a refund may be agreed upon at the Artist’s discretion. The Client needs to allow seven (7) days from the date of contact for the Artist to reply, as any chargeback claims initiated before the seven days may be rejected or paused by the Client’s payment provider. If a refund is applicable, the percentage of the original purchase price will be negotiated and agreed upon. Disliking the Commission or a change of mind are not considered valid reasons for a refund; this is mitigated by providing drafts and progress photos/screenshots throughout the Commission process. No refunds can be negotiated if the reason for a refund is to make any changes within the finished artwork after the Commission is completed. Any changes must be agreed upon prior to the Commission being completed and delivered; otherwise, additional fees may apply. The Client will have seven (7) days to delete/destroy digital formats of the Commission if saved on their personal devices/cloud/email storage and deleted from their Profiles if posted. The refund will be paid back to the Client at the discretion of the Artist once the Commission has been deleted.
NOTE: The Artist may not be able to refund 100% of the original purchase price of the final Commission due to any additional transactional and/or chargeback fees incurred. Additionally, any deposits made after the Start of Work but before the Final Commission will not be eligible for refunds.19. COMMISSION CONFLICT:
The Client may not incorporate the Commission in AI generated artwork or databases, NFT’s, and another work of art (or another Artist’s Commission). A take-down notice will be issued in such cases and Term 22 will be applied as necessary.20. PREVIEW REQUESTS:
The Client may request a preview of the Commission at any time during the creation process, but may not request changes to the Commission after Start of Work or approval of the draft/thumbnail sketches, unless agreed upon in the Commission Agreement prior to Start of Work.21. MISCELLANY:
This Agreement constitutes the entire understanding between the parties. Its terms can be modified as an addendum if agreed by both parties in the Commission Agreement. A waiver of any breach of any of the provision of the Agreement shall not be construed as a continuing waiver of other breaches of the same or other provision hereof. This Agreement shall be governed by United Kingdom laws.22. DAMAGES:
The Artist has the right to pursue damages under UK Copyright Law, UK Defamation Law, and any other applicable laws, should there exist a violation in addition to a breach of these Terms of Service.

When you commission me, you're paying for my work, but I still own the artwork. That means I can use it for things like showing my skills to others. You can't change or sell it without asking me first.7. COMMISSION DESCRIPTION:
Before we start, tell me exactly what you want. If it's complicated or big, it might cost more. Let me know how big you want the picture to be, too.8. DEADLINES AND FLEXIBILITY:
I won't take commissions with tight deadlines or if you're not flexible about when you need it. I'll give you an idea of when it'll be done, but sometimes it might take longer. I'll keep you updated along the way.9. CONFIDENTIALITY:
If you want to keep the commission private, just let me know. I won't show it to anyone until you say it's okay. There might be extra charges for this.10. PUBLIC DISPLAY AND USE:
You can show off your commission online, but make sure to give me credit. You can't use it for contests or put it in public spaces without asking me first.11. COMPETITIONS:
Don't enter your commission into any contests, online or offline.12. DIGITAL COMMISSIONS:
I'll send you the finished artwork (.jpg or .png) by email or through an online download link. You won't get the original working files (.psd or .clip) unless we agree otherwise.13. PRINTS AND PRODUCTS:
I won't print your digital artwork for you, but you can print it locally if you want. Just make sure it is only for your personal use, and that you are not selling it or entering it into contests.14. PROMOTION:
I might use your commission to show my work to others, but I won't sell it or make merchandise without your permission.15. ADDRESS NOTICE:
Make sure your contact details are correct. Let me know if they change.16. EXPIRATION:
This agreement lasts for a long time, even after the commission is done. But if we need to change it, we can.17. MORAL RIGHT:
You can't use my name or the commission in a way that might harm my reputation.18. REFUND POLICY:
If you're unhappy with the commission for a good reason, let me know within two weeks. I might give you a refund, but it depends. Deposits are non-refundable if I have already started work on your commission.19. COMMISSION CONFLICT:
You can't use the commission in AI-generated artwork, other artworks, or contests.20. PREVIEW REQUESTS:
You can ask to see how the commission is going, but you can't ask for changes once I start working on it. However, I do offer free small revision rounds during key points of its creation.21. MISCELLANY:
This agreement is our deal. We can change it if we both agree. If one of us breaks the rules, it doesn't mean the rules don't apply anymore. We'll follow UK laws.22. DAMAGES:
If someone breaks the rules and causes harm, I have the right to take legal action under UK laws.

How many revisions can I have on the commission?
You'll receive three rounds of free reasonable revisions during the creation process: at the thumbnail/sketch stage, lineart stage, and final colouring check-in. Additional revisions may incur a Major Alteration fee.How long do I have to pay the invoice once the commission is finished?
The invoice must be paid within 45 days of completion. Reminders will be sent after 30 days and on the due date. Failure to pay within 45 days may result in late fees, interest, or cancellation. If you're unable to pay, please inform me promptly to discuss options.What happens if I don't pay my invoice on time?
If payment for your commission is not received by the due date specified on the invoice, late fees and interest may apply. It's important to ensure that payments are made promptly to avoid any additional charges. Can I use the commissioned artwork for commercial purposes?

A collaborative Sonadow fancomic with artist PowPowChaos, Tails attends college with Sonic as his legal guardian. Having to be in disguise, Tails is a regular child genius called Nines, and Sonic is a local flowershop owner called Nicky. What they didn't expect was one of the college professors being none other than Shadow the Hedgehog; but will he see through their disguise?
